Terms of Service

These Terms of Service govern your use of Pockifi's bill comparison and savings reporting service, including the Pockifi Shield subscription. Pockifi uses artificial intelligence and human review to analyse your utility bills and identify potentially better deals from Australian providers. Pockifi Shield membership fees are charged after your personalised savings report has been delivered to you and you have chosen to proceed. All Shield memberships are backed by a 300% money-back guarantee, the conditions of which are set out in Section 6 of these Terms.

1 Acceptance of Terms

By accessing or using Pockifi's website and services at pockifi.com.au, you agree to be bound by these Terms of Service and Pockifi's Privacy Policy. These two documents together constitute the entire agreement between you and Pockifi in relation to the services described herein. By ticking the consent checkbox and submitting any form on pockifi.com.au, you confirm that your electronic acceptance of these Terms constitutes a legally binding agreement, equivalent in effect to a written signature.

If you do not agree to these Terms, do not use Pockifi's services. These Terms apply to all visitors, users and customers of Pockifi.

You must be 18 years of age or older and an Australian resident to use Pockifi's services. By using our services, you confirm that you meet these requirements.

2 Description of Services

Pockifi provides a bill research and savings reporting service for Australian households and small businesses. Pockifi's services include:

Pockifi provides research and recommendations only. You are responsible for contacting providers and making any switches. Pockifi does not switch providers on your behalf unless a specific assisted switching service is offered and you have requested it.

Pockifi applies its own professional judgment when preparing savings reports. This may include recommending a different plan with your existing provider rather than a new provider, or identifying a well-established provider where the practical benefit to you is greater, even if a marginally cheaper alternative exists. Pockifi's goal is to identify a deal that represents genuine savings and is practical for you to act on. You are engaging Pockifi for research, expert judgment and a money-back guarantee, not for a guarantee that no cheaper deal exists anywhere in the market at any given moment.

Pockifi's services are available to Australian residents and businesses only.

3 AI and Technology Disclosure

Pockifi uses artificial intelligence tools to assist in reading and extracting information from uploaded bill documents and in comparing available market options. This includes the use of reputable AI language model platforms to assist with data extraction, market research and report preparation. Pockifi's team reviews AI-generated outputs before any savings report is sent to you.

As Pockifi develops its service, AI-assisted processing may also include automated workflows and AI agent systems operating with reduced or no human involvement at each step. Where such automated processing materially affects how your information is used, Pockifi will update its Privacy Policy accordingly.

Members should be aware of the following limitations of AI-assisted analysis:

4 Your Responsibilities

In using Pockifi's services, you agree to:

Medical devices: If any resident at your property relies on an electrical medical device (such as a CPAP machine, oxygen concentrator, home dialysis equipment or life-support equipment), you are responsible for disclosing this directly to any new energy retailer when switching. Australian energy retailers are required under the National Energy Retail Rules to register such households and provide additional protections. Pockifi will include a reminder in your electricity savings report, but the disclosure obligation rests with you as the account holder.

Concession entitlements: If you hold a pensioner concession card or other government concession entitlement, your entitlements do not change when you switch energy retailers. Pockifi recommends confirming your concession status with your new retailer after switching and ensuring it is applied correctly to your new account.

4b Property Coverage

Each Pockifi Shield membership covers one residential or investment property. The covered property is the address provided at the time of sign-up. If you wish to cover a second property, a separate Shield membership is required for that address. Each property's membership is billed independently and carries its own 300% savings guarantee. To add a second property, sign up again at pockifi.com.au/shield using the address of that property.

The free bill analysis service operates on a per-property basis. Each bill upload is treated as a separate analysis for the property shown on that bill.

5 Locked-In Contracts and Exit Fees

Before acting on any Pockifi savings report, you are responsible for confirming whether you are subject to a lock-in contract or exit fee with your current provider. Pockifi will flag known contract indicators identified from your bill where possible, but cannot guarantee it will identify all contract terms or conditions.

Pockifi accepts no liability for exit fees, device payout costs or penalties incurred as a result of acting on a savings report. It is your responsibility to confirm the full cost of switching with your current provider before proceeding.

6 Pockifi Shield — Membership Terms

Important notice — auto-renewal: Pockifi Shield memberships renew automatically. Annual memberships renew after 12 months. Monthly memberships renew each calendar month. You will receive a reminder email before each renewal. To cancel auto-renewal at any time, email hello@pockifi.com.au. There is no cancellation fee.

Pockifi Shield is a subscription-based quarterly bill monitoring and savings reporting service. The following terms apply to all Shield memberships:

7 Referral Program

Pockifi operates a member referral program. When you refer a person who becomes a paying Pockifi Shield member, you are entitled to a $20.00 digital gift card as a reward.

To claim a referral reward, email hello@pockifi.com.au with the subject line “Referral Claim” and provide the name and email address of the person you referred.

8 Referral Commissions from Providers

Pockifi earns a referral commission from energy and telecommunications providers when you switch to a new provider as a result of a Pockifi recommendation. This commission is paid by the provider to Pockifi and does not affect the price you pay. The deal you receive is identical to approaching the provider directly.

Referral commission arrangements do not determine which providers or plans Pockifi recommends. Pockifi researches the available market based on your usage and circumstances and is not restricted to providers who pay referral commissions. Pockifi does not guarantee that every savings report will identify the single lowest-priced option across every provider in the market at that moment. Pockifi’s goal is to identify a genuinely better deal suited to your usage, location and practical circumstances.

Pockifi is not a financial adviser. Savings estimates in your report are indicative only and are based on publicly available rate information at the time of research. Actual savings will depend on your usage, location, specific plan terms and any pricing changes between the time of research and the time you contact the provider.

9 Intellectual Property

All content published on the Pockifi website, including text, graphics, logos, software and reports prepared by Pockifi, is the intellectual property of Pockifi and is protected by the Copyright Act 1968 (Cth) and other applicable Australian intellectual property laws. You may not reproduce, distribute, adapt or use Pockifi’s content for any commercial purpose without prior written permission from Pockifi.

10 Limitation of Liability and Consumer Guarantees

Nothing in these Terms of Service excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable Commonwealth, State or Territory legislation that cannot lawfully be excluded. To the extent permitted by the Australian Consumer Law, Pockifi’s liability for a failure to comply with a consumer guarantee is limited to re-supplying the relevant services or paying the reasonable cost of having the services re-supplied.

To the extent permitted by applicable Australian law, Pockifi’s total liability for any claim arising from your use of Pockifi’s services is limited to the total amount you paid to Pockifi in the 12 months preceding the claim. Pockifi is not liable for indirect, incidental or consequential losses, including loss of anticipated savings, loss of data, or disruption to your utility services, arising from your use of Pockifi’s services.

11 Communications Compliance

All commercial electronic messages sent by Pockifi comply with the Spam Act 2003 (Cth). You may unsubscribe from Pockifi’s marketing communications at any time by clicking the unsubscribe link in any marketing email or by contacting hello@pockifi.com.au. Transactional emails relating to your active membership, billing, savings reports and account updates are not marketing communications and will continue to be sent as necessary to deliver the service.

Pockifi complies with the Do Not Call Register Act 2006 (Cth). Pockifi will not make unsolicited telemarketing calls to numbers registered on the Australian Do Not Call Register.

12 Termination

Pockifi reserves the right to suspend or terminate access to its services where a user has materially breached these Terms or engaged in conduct that Pockifi reasonably considers harmful to its operations or other users. You may cease using Pockifi’s services at any time by contacting hello@pockifi.com.au.

13 Complaints and Dispute Resolution

If you have a complaint about Pockifi or its services, please contact us in the first instance at hello@pockifi.com.au. Pockifi will acknowledge your complaint within 2 business days and work to resolve it within 10 business days.

If Pockifi cannot resolve your complaint to your satisfaction, you may contact the relevant external body depending on the nature of the complaint:

14 Governing Law and Jurisdiction

These Terms of Service are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia for any dispute arising under or in connection with these Terms that cannot be resolved through Pockifi’s complaints process.

15 Severability

If any provision of these Terms of Service is found to be invalid, unlawful or unenforceable under applicable Australian law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions of these Terms will continue in full force and effect.

16 Changes to These Terms

Pockifi may update these Terms of Service from time to time. Pockifi will notify you of material changes by email or by notice on the website. Continued use of Pockifi’s services after changes take effect constitutes acceptance of the updated Terms.
